摘 要：强制拆迁是近些年来引发社会矛盾的主要原因之一。究其根本，在于其所依据的《城市房屋拆迁管理条例》存在明显的缺陷，其本身的制定就涉嫌违宪，且《城市房屋拆迁管理条例》中的各种规定也存在着不少有争议。再加上政府针对相对人得权利和依法行政观念的淡薄等原因，在实践中非法强制拆迁的现象非常普遍，公民的基本财产等权利受到了巨大的威胁。针对这一系列的问题，我国废除了涉嫌违宪违法的《城市房屋拆迁管理条例》。本文分析了问题存在的原因，并在此基础上对我国强制拆迁行为的法律调整及完善提出建议。

Abstract：Frced evictions in recent years is caused by one of the major social conflicts.
