对电子商务中的知识产权保护的分析
随着计算机技术的飞速发展、因特网的兴起和应用的普及以及一系列相关技术的创新，数据的处理和信息的传递突破了时间和地域的限制，信息化时代的到来成为不可抗拒的潮流，人类文明正在进入一个崭新的时代。信息时代极大地改变了人类的行为、思维、交流和贸易方式。作为信息时代的产物和宠儿，全球电子商务因此而获得了迅速的发展，成为信息时代初级阶段最具活力的代表，并对世界经济的发展形成了强大的推动力。
摘 要
知识产权是公民、法人或其他组织对其智力劳动成果依法享有的占有、使用、处分和收益的专有权利。随着英特网的普及和发展，在电子商务的知识产权中也逐渐产生越来越多的纠纷。如何维护电子商务中的权益成为人们越来越关注的问题。
通过建立和完善知识产权保护制度和加强知识产权国际保护的协调工作，能够促进我国电子商务良好发展。本文阐述了电子商务的发展状况及遇到的知识产权问题；并详细分析了电子商务中的知识产权，如：域名、数据传输等；最后针对我国目前电子商务的发展现况，通过现实案例分析，结合相关法律理论提出了有效的对策。

Abstract
Intellectual Property Rights is one kind of proprietary rightsthat citizens, legal persons or other organizations should beentitled to deal with their intelligence achievement, such asholding, using, punishing and also gaining of proceeds. With thepopularization and development of the Internet, there is a fiercedebate about E-Commerce intellectual property, more and more peopleare concerned about the problem that how to protect this rights insuch an E-Commerce environment. Only via establishing andfine-tuning Chinese intellectual property rights protection systemand strengthening the international protection of intellectualproperty can we develop the E-Commerce in our countryhealthily.

Second, thepaper analyzes the problems of the intellectual property inE-Commerce, such as domain names, data transmission and so on.Finally, the paper makes useful recommendations according to thecurrent E-Commerce development status by analyzing actual cases andrelated law theory.
