摘 要
     根据目前的法律法规基础下，农村集体建设用地使用权不准进入市场化交易流转。然而，现实社会的变化，与文明的法律文件存在一定的差距。根据实际情况，在利益的驱动下，农民将手中的农村集体建设用地使用权规避法律限制进行私下隐形交易流转，被法律制度禁锢却在实际中跨越法律制度的限制的农村集体建设用地使用权流转是本研究深入思考的一大问题。对此，本研究首先对农村集体建设用地和农村集体建设用地使用权两大理论进行界定，然后全面分析农村集体建设用地使用权在法律范围内的基本情况，挖掘出农村集体建设用地使用权流转在相关法律中存在的问题以及这些问题的根源，紧密结合实际，探索出一套农村集体建设用地使用权改革的策略，希望通过本研究，为我国农村集体建设用地使用权的流转在法律方面规避问题等有所借鉴价值。

Abstract
    Under the current laws and regulations basis, rural collective construction land use right transfer transactions are not allowed to enter the market . However , changes in the real world of legal documents , and civilization there is a gap . According to the actual situation , in the interests of drivers , farmers of rural collective construction land use right hands to circumvent legal restrictions on invisible transactions in private circulation , rural collective construction land use right transfer has been detained beyond the legal system legal system in practice limited this study is a major problem to think deeply . In this regard, this study of rural collective construction land and rural collective construction land use rights are two theories to define and comprehensive analysis of the basic situation of rural collective construction land use rights within the law , and dig out the rural collective construction land use right transfer in a related law problems and root causes of these problems , realities, they explore a set of strategies of rural collective construction land use rights reform in the hope that through this study , for the transfer of rural collective construction land use right of the country to circumvent the legal aspects some reference value problems.
